When can a worker submit a request to prove the maliciousness of a report of absence from work?

A worker can file against the report of absence if he or she was absent from his job for a legitimate reason. Among the reasons accepted by the responsible authorities are:

• If the worker was imprisoned and his absence was falsely reported.
• If the worker was hospitalized due to illness within the reporting period for his absence.
• If the worker files a lawsuit against his sponsor before the date of his absence.
  
  

The worker or his representative can submit a request to prove the absence from work was false through the website of the Ministry of Human Resources and Social Development.

The conditions:

• To have an account in the individuals e-services portal for ministry of human resources
• It is not possible to submit a request to prove the maliciousness of a report of absence after one year has passed since it was submitted by the facility against the worker.
• It is not possible to submit a request to prove the maliciousness of an absenteeism report that was previously rejected by the Absenteeism Reporting Department.
• It is not possible to submit more than one malicious proof request for the same communication.
